    Thanks to everyone for such rapid and helpful replies. Dbevis asked what I was trying to achieve. I should have mentioned this; I'd come across the concept of hyperfocal distance and its calculation. I realised that I had no idea what the focal length of the zoom lens is at any setting (other than at the wide-angle (and telephoto) end of the zoom scale). Having said all that, by putting in some trial numbers into the hyperfocal distance equation - representing the focal lengths at the bottom end of the zoom range and at various logical aperture settings - it turns out that the furthest hyperfocal distance I'm likely to encounter is about 10 feet. Now, I must see if theory is borne out by practice. I have had the camera 4 years now and I never seem to stop learning something more about it.

    Many thanks for the ideas submitted; I will see what I can discern with a tape measure fixed to a wall.

    Hi,
    I am in your stage. I am in AOS stage with EAD. I applied for FAFSA and I do qualify under 'Qualified Non-Citizen.' But, the school financial aid office was not aware of my situation and it took more than a month for me to educate and make them aware of this.

    The FAO people only know about GC or Citizen. You will have to talk to the
    School's International Office to evaluate your situation and ask them to talk to your FAO to explain about your immigration status.

    Hi,
    I filed for I-485 in July 2007. At that time I had an out-of-status issue. I had discussed the option of going out of the country and re-enter(to have a clean slate) before filing with my lawyer, she suggested going to Canada was more riskier.

    There was a delay in switching from L1 to H1B after H1B and a change of status was approved in Oct 2005. I switched to my H1B employer only on April 1st 2006. So probably was out of status for 182 days.

    Is it a given that USCIS will find this issue?

    I was reading about the 245(k) memo, that USCIS can forgive up to 180 days of 'out of status' since the last lawful entry.
    I haven't gone out of the country since Jan 2005. So still had 182 days of 'out of status' when the 485 was filed.



    I'm planning a trip outside of the country by end of October. My question is that, will my re-entry (using H1-B) and subsequent stay in correct status be good enough for 245(k) ?
    Will my previous 182 days of 'out of status' will be erased and overlooked for 485 purposes?.

    Or did I have to have a clean status at the time when 485 was filed? Re-entry and maintaining status after filing 485 does not count ??

    245(k) can be used to adjust status if a person failed to maintain non-immigrant status for fewer than 181 DAYS since the LAST entry until 485 was FILED Re-entering and maintaining status after 485 was filed can not help currently pending 485. If a person was out of status for more than 180 days, the underlying 485 can't be approved, IF USCIS NOTICES this. ...The odds are USCIS will not notice this. Another way of going about this problem, would be to re-file 485 after re-entering U.S. on a dual intent visa and maintaining the status when your PD is current again. Such 485 would be then approvable. Hope this makes any sense.

    Hello,

    This is my status.

    I 140 � Approved in 2006 and have a copy.
    I 485 � Filed in Jul 2007, Receipt date Jul 02, 2007. Have copy of I 485 receipt.
    Perm Labor � Have perm labor approval copy.

    Since it has been more than 180 days I 485 is pending and I 140 also approved, I joined my client. Now my old employer says he will withdraw my I 140.

    I would like to send AC21 job change info to USCIS my self.

    Please let me know if any one is in the same situation and filed (informed) AC21 by yourself.

    And also advice if anyone used new attorney only for AC21.

    One quick question, does perm labor approval copy will have any job details/code on it or just approval notice ?

    US Govt don't have to worry about it because we don't qualify for UnEmployment Benefits anyways.

    Now thats a different story that we pay unemployment and SS taxes but we don't get any benefits out of it.....:(

    What is the difference between L1B and H1B? Why don't companies hire on L1B when H1B's are over? Thanks.

    L1B is comany transfer, for L1B company need to have good revenue for sponsoring L1b and L1b holder must work on the it�s country for minimum of year. Now a days there is restrictions like only computer back ground people need to apply for L1 ( BE/B.Tech in CSE,EEE,ECE) on this because companies are misusing it for no annual cab.

    Since it is company transfer H1B is not eligible for L1B ( you have to work in the company home country for 1 year to be eligible) but L1B is eligible for H1b. But many of the Indian companies are not sponsoring green cards for L1A and L1b of then do then they will also face retrogression.

    Well, most of us July filers--including myself--are little stressed out due the Receipt Notice issues, but now I have learned how to live happy even at hard times. Here is how I imagine the NSC center works. A busy morning at NSC mail room.:)

    Mail room Clerk: Good morning officer! Today's quota of I-485 Receipt Entry is 3000. In what order I have to pull the 3000 applications from the mound of applications?

    Officer: Order? Are you out of your mind? Did you forget my instructions? Go to Rack # 10 and pull 1000 applications, and go to Rack # 15 and pull 1200 applications, and finally go to Rack # 21 and pull 700 applications. It will take just take 10 minutes. If you sort all these applications, it will take hours and hours. Try to be a smart man. OK?

    Clerk: Yes sir, I will do it 10 minutes.
    (Clerks completes the officier's instruction and comes back with the applications, but seems confused)

    Clerk:Sir, it looks like we pulled only 2900 applications, but still we need 100 more.

    Officer: What? How did it happend? OK. Let me think. Go to the 'Rejected Applications' rack and pull 100 applications, closing your eyes. It is important you close your eyes and pull the application. Understand?

    Clerk: Yes, sir.

    (The clerk gets the 100 applications from the 'Rejected Applications' rack)

    Clerk: Sir, I am done.

    Officer: OK. Now, one final time. Count the applications and make sure we have only 3000 applications.

    (The clerk counts the applications again....)

    Clerk: In a panic voice, says, "Sir, I don't know how this happend, but we have 3600 applications instead of 3000, but I did't make any mistake, Sir.

    Officer:Man, you are always a pain in my ass. Now we have 600 more applications in hand..Hmmm.. Let me think. OK, just transfer these 600 applications to TSC, and today's problem is solved.

    Clerk: Yes, sir.

    Officer: Bye, see you tomorrow.

    You are correct then only Andhra Pradesh have been retrogressed. If you remove AP from that equation. everything will be normal.

    I can bet 90 percent of the GC applicants are from India are from AP.

    GC is for the future job and hence if your prospective employer will be able to proceed with your GC in your absence till its very end then you should be fine and still be able to come into US as a GC holder when GC is offered to you. However in this case you can't do Adjustment of status since you willn't be staying inside US and hence have to opt for Consular processing if you haven't opted for Consular processing.
